A WIN IN THE U.S.  SIXTH CIRCUIT COURT OF APPEALS. On August 18, 2014 in Nifadev v. Holder, (Case No. 13-3704/4222
6th Cir. 2014), the United States Court of Appeals for the Sixth Circuit held that Mikheil B. Nifadev has proven his claim that he
had suffered persecution by reason of his Russian ethnicity at the hands of the security and regular police of Uzbekistan.   The
Court vacated the decision of the Board of Immigration Appeals (BIA) in Washington, D.C. which had denied Mr. Nifadev asylum,
and the Court remanded the case with additional instructions to the United States Attorney General, including that the BIA should
determine whether the BIA should also reconsider its denial of Nifadev’s application for withholding of removal and protection
under Convention Against Torture (abbreviated CAT for Convention Against Torture And Other Cruel, Inhuman or Degrading
Treatment or Punishment of the United Nations) in light of the opinion of the Court.  The Sixth Circuit opinion essentially and
explicitly held that
"[b]ecause the IJ [Immigration Judge] appears to have erred in her determination that Nifadev did not suffer
past persecution and because the IJ clearly misinterpreted Nifadev’s credible testimony regarding the ethnic animus of the
Uzbekistan security officials, we find that Nifadev has made out a credible case of being a refugee under the definitions of
8 U.S.C. § 1158(b)(1)(A)."
 [Emphasis added].   The United States Immigration Court in Cleveland, Ohio, had initially
found Mr.  Nifadev and his witnesses to be credible but declined to grant asylum because it erroneously determined that
Mr. Nifadev had NOT suffered persecution.   Shown in photograph on the right is Mr. Mikheil B. Nifadev with Charleston

Pursuant to the Sixth Circuit opinion, the BIA on January 5, 2015, ordered the Immigration Court to grant asylum to Mr. Nifadev.

    "Chain Migration"  is a Disservice to Humanity

The phrase  "chain migration" is making its way into our popular vocabulary.
As a practicing immigration lawyer for many years, I have never heard of it
until last year.  When I first heard of the phrase, it conjured up images of
persons coming to these shores in chains, the  involuntary migrants in the
slave ships crossing the Atlantic.  

President Trump recently has taken to speaking of  ending that "horrible
chain migration" and I started to investigate further.   Of course, Mr. Trump
was not talking about stopping modern slavery or even human trafficking -
instead, he was talking about the breaking up of migrant families as the new
immigration policy.  Attorney General Jeff Sessions  III, Homeland Security
Secretary Kirstjen Nielsen and other  Cabinet members have also attacked
“chain migration,"  painting it a threat to American workers and national
security.  The marching order is "stop chain migration."

What an Orwellian travesty of our American language!    The family has
since time immemorial been the basic foundation of human civilization.  
Indeed. after the genocides of the last century, the integrity of the family
remains the basic foundation of human survival.  People have always
migrated with their families, to wit for example the Mayflower, whose
passengers were not in chains.   Today, defending and preserving the
family structure must a primary purpose of a sovereign and free people.  

Since 1965,  U.S. immigration policy has explicitly protected family unity
on a worldwide basis.  This makes common sense.  If we want to attract
exceptionally skilled and talented immigrants, we cannot tell them to
leave their families behind.  Since the industrial revolution,  nations all
across the world are engaged in a relentless competition to develop new
technology and the United States has always benefited from attracting
talent that time and again has given us the edge in economics and indeed
armed conflict.

The first step is to call the deuce a deuce.   We cannot in 2018 with a
straight face make policy to protect American families on one hand and
use the other to fracture the families of migrants.   When we debate
controversial immigration issues which inevitably will involve family based
migration, let us think and speak in terms of family unity or if you must,
family disunity.  Let us join hands and banish "chain migration" from our
discourse because it is a vicious diminution of our humanity.
