A WIN IN THE U.S. SIXTH CIRCUIT COURT OF APPEALS. On August 18, 2014 in Nifadev v. Holder, (Case No. 13-3704/4222
6th Cir. 2014), the United States Court of Appeals for the Sixth Circuit held that Mikheil B. Nifadev has proven his claim that he
had suffered persecution by reason of his Russian ethnicity at the hands of the security and regular police of Uzbekistan. The
Court vacated the decision of the Board of Immigration Appeals (BIA) in Washington, D.C. which had denied Mr. Nifadev asylum,
and the Court remanded the case with additional instructions to the United States Attorney General, including that the BIA should
determine whether the BIA should also reconsider its denial of Nifadev’s application for withholding of removal and protection
under Convention Against Torture (abbreviated CAT for Convention Against Torture And Other Cruel, Inhuman or Degrading
Treatment or Punishment of the United Nations) in light of the opinion of the Court. The Sixth Circuit opinion essentially and
explicitly held that "[b]ecause the IJ [Immigration Judge] appears to have erred in her determination that Nifadev did not suffer
past persecution and because the IJ clearly misinterpreted Nifadev’s credible testimony regarding the ethnic animus of the
Uzbekistan security officials, we find that Nifadev has made out a credible case of being a refugee under the definitions of
8 U.S.C. § 1158(b)(1)(A)." [Emphasis added]. The United States Immigration Court in Cleveland, Ohio, had initially
found Mr. Nifadev and his witnesses to be credible but declined to grant asylum because it erroneously determined that

END APARTHEID SLAVERY IN MAURITANIA
Apartheid has not died in Africa. Apartheid is very much alive in Mauritania. The refusal of the "white Moor" government of Mauritania to curb
the endemic enslavement of its black citizens prompted President Donald Trump through the office of the U. S.. Trade Representative to give
notice on November 2, 2018 that the United States will terminate trade preference benefits with Mauritania in 2019. In addition to the prevalence
of hereditary race based slavery, the White House also determined that the government of Mauritania continues to restrict the ability of civil
society to work freely to address anti-slavery issues.
This moral stance of the President is laudable. Yet U. S. immigration enforcement (ICE) recently has began aggressively targeting black Africans
from Mauritania who have sought asylum in the USA to detain for the purpose of deporting them back to a country where race-based slavery is a
feature of the landscape. Most of the Mauritanians including those living in Cincinnati have been here for decades and have family and children
This immigration police activity is inconsistent with the trade sanctions imposed on Mauritania for its acquiescence of race based slavery.
Renewed protection must be afforded black Mauritanians who have sought asylum with us.
In the last century, the world took aim at apartheid in South Africa in an effort to end racial segregation and color discrimination in that country.
Concerted world opinion and the powerful moral stand taken accelerated the demise of apartheid in South Africa. Beginning with the release of
Nelson Mandela from prison in 1990, apartheid effectively ended with Mr. Mandela's election as President of South Africa in April 1994.
Yet oddly, the enslavement of people based skin color is a fact of life in Mauritania in the 21st century today. The deeply entrenched existence of
white on black slavery in Mauritania is a renewed form of apartheid that the world succeeded in ending in South Africa. Indeed, this Mauritanian
apartheid is just as atrocious, if not more so than that of South Africa. Slavery in any form is a terrible scourge on humanity. It is time that all
decent people everywhere stood up once more and ensure the end of de facto slavery in Mauritania.

Will you strive for justice and peace among all people, and respect the dignity of every human being? I will, with God’s help. The current immigration policy of our government systematically creates a false narrative of immigrants as criminals while simultaneously creating dehumanizing situations, in the hope that this will serve as a deterrent to migrants. Among the cruelest policies is the separation of children from their parents, detaining them in conditions no child anywhere should suffer, and certainly not children in the care of the American government. Independent observers have witnessed children sleeping on concrete floors in frigid, overcrowded cells, without soap or toothbrushes. Young children were caring for even younger children. Human dignity is not a matter of political opinion or expediency. We cannot condone using human beings as bargaining chips in an effort to discourage people from crossing our borders. Border security is a legitimate goal for any nation, but as Christians we have a higher calling. We are called to treat and serve the foreigners among us as though they were our own citizens, our own neighbors, our own family (Leviticus 19:33-34). |
