CHARLESTON C. K. WANG, ESQUIRE WINS DUE PROCESS DECISION IN THE OHIO COURT OF APPEALS FOR HAMILTON COUNTY.
On May 2, 2012, in the case of
State of Ohio v. Zou, the Ohio Court of Appeals for the 1st Appellate District of Hamilton County held
that Ohio Criminal Rule 29(A) applies to traffic violations of the Cincinnati Municipal Code because they are criminal misdemeanor
offenses and "the idea that a defendant is presumed innocent until his guilt is established beyond a reasonable doubt is the very
cornerstone of our criminal justice system. It is, by design, a difficult standard to meet, and any charge to the jury which lessens the
standard or which leaves the jury uncertain as to what the standard is or how it is to be applied is not acceptable. .....If it is error for a
trial court to fail to properly instruct a jury on reasonable doubt, it is also error for a court to fail to apply the correct standard in a

                     OUR CONSTITUTION: IMMIGRATION IS A NATIONAL PRIORITY

The United States Supreme Court in Arizona v. United States has once again held that under our Constitution, immigration is a national priority. The federal
power to determine immigration policy is well settled now, and has been for over a hundred years before. The reasons are unassailable - the Court noted that
immigration policy can affect trade, investment, tourism, and diplomatic relations for the entire Nation, as well as the perceptions and expectations of aliens in
this country who seek the full protection of its laws. Art. I, §8, cl. 4 of the United States Constitution in providing Congress to “establish an uniform Rule of
Naturalization,” says as much.

Yet the Governor of Arizona rushed to claim victory in this landmark court battle. The reason is that the high court gave Arizona a little breathing room in
holding that a state may empower its officers who conduct a stop, detention, or arrest to make efforts, in some circumstances, to verify the person’s
immigration status with the Federal Government. That is all and for now because litigation on the full merits of the Arizona law will continue in the lower courts.

Legislators in other states of the union, including Ohio , have already seized upon this to clamor for new and draconian state laws against unwanted
immigrants by "attrition through enforcement." Such enthusiasm runs afoul of our Constitution. The Nation's highest court has held that (1) Arizona may not
further criminalize undocumented presence of aliens, (2) bar them from working, and (3) make warrantless arrests of persons believed to be deportable.  The
reason is that Federal law already exists in all these respects and preempts any state initiative on the same subject. Federal preemption is nothing new and
exists in other spheres such as interstate commerce, labor relations, and national security.

Finally, the 5-3 decision joined by the Chief Justice, is firmly grounded in the our Constitution. In its decision, the majority of the Court allowed Arizona an one-
quarter consolation award and it will be prudent for state legislators to value it as such and to not overdraw on it. On the other hand, immigration remains our
national priority. The conclusion of majority opinion by Justice Kennedy says it all:

"Immigration policy shapes the destiny of this Nation. ... The history of the United States is in part made of the stories, talents, and lasting contributions of
those who crossed oceans and deserts to come here. The National Government has significant power to regulate immigration. With power comes
responsibility, and the sound exercise of national power over immigration depends on the Nation’s meeting its responsibility to base its laws on a
political will informed by searching, thoughtful, rational civic
discourse."

                                                                                   War Comes to Banias

This Sunday morning during the Coffee Hour, my fellow traveler in the Holy Land, Ron Turner told me in anguish that war had come to Banias and many refugees had been killed
there.  We knew that shortly afterwards, the Israeli air force had attacked Damascus.   Our thoughts immediately returned to our rather idyllic and peaceful 2010 visit to the ancient
shrine of Banias located in the Golan Heights.   Since 1967, the Golan is disputed ground between Syria and Israel and we imagined that the Syrian civil war was spilling over into
this contested space and this was why Israel attacked from the air.

                                                                          Lost in the Fog of War

When I got a chance to put my fingers on the keyboard that got me into the world-wide-web, I began to realize that we had gotten lost in the fog of war - a little at least and the
shame of it was that we were safe and sound in the undercroft of Christ Church Cathedral in Cincinnati.   After a few minutes of research, I discovered that the distressed Banias
was a little Syrian town on the Mediterranean coast and not the biblical site on the heights of the Golan, where we spent a pleasant day as pilgrims of the Lord.  Jesus knew the
place as Caesarea Philippi and immortalized it with his Messianic Secret.  I was somewhat relieved - but then does that matter when at least 62 civilians, 14 of them children were
massacred by soldiers with tanks and possibly chemical weapons?

                                                                               Does it Matter?

Did it matter that the victims were Sunni killed by other Alawite Muslims in a sectarian civil war?   As for me, an attorney who in the last few decades have been practicing the law
on behalf of refugees and asylum seekers who cannot return to their homes by reason of persecution, including mistreatment because of politics, religion, and social grouping,
the answer is an emphatic NO - all that matters is that they were killed.   Was Israel justified in bombing Damascus for two days now?  That is a more difficult question - combat
between Nations commences for many reasons, and I should try to discern whether the air attacks were purely out of concern for the massacre at Banias or was Banias a mere
pretext.   If the Banias was indeed the one in the Golan, justification becomes more plausible, but the other Banias many miles to the north?   I conclude that the air attacks had
nothing to do with the atrocities at Banias at all.

                                                                               Peace will come!

How many were killed in the air raids?   I have no information to answer that. Tel Aviv, in its calculus of war, is betting that Bashar al-Assad will not have the opportunity to move
against the Banias in the Golan, and attempt to bring war into Israel.  How many more will die?  Many more Syrians I am certain, and possibly young men and women from other
Nations too.  But peace will come, as it has to all wars whether internal or international.  God has not allowed any particular war to go on forever, but inexplicably, has not stopped
others from starting.

                                                                       Jesus and the Peacemakers

Jesus said, "Blessed are the peacemakers: for they shall be called the children of God."  But in the same breath Jesus also said, "Blessed are they which are persecuted for
righteousness' sake: for theirs is the kingdom of heaven
."  In my practice of asylum law, I elicit carefully all the facts of mental and physical persecution suffered by the claimants
including violations of the United Nations Convention Against Torture and other Cruel, Inhuman and Degrading Treatment or Punishment.   I look for corroborating evidence.   The
purpose is to prove before the Immigration Court that these heinous facts are true, in which case my client wins the privilege to remain in the USA.  And the job of the Government
lawyer who opposes us is to prove they are false in which case my client is deported.   Such is our adversarial system of justice.  

                                                                             My Prayer for Peace

When relating stories of persecution, how I too wish that the facts I set out to prove are false and often I pray that all is but a dream.  Dreams notwithstanding, I pray for Peace,
